— A man deemed responsible for a two-car collision that took the life of a Walhalla man two years ago is now facing a charge of reckless homicide.

Michael Cibulskis, now 20 years old, of Salem, was taken into custody Wednesday by South Carolina Highway Patrol (SCHP) officers and booked at Oconee County Detention Center.

On June 20, 2007, Cibulskis’ 2002 Oldsmobile sports utility vehicle crossed over a median as he traveled eastbound on U.S. 123 near Seneca, striking David Burton’s Ford Ranger head on. Burton, 37, was declared dead at the scene.

Cibulskis was in critical condition following the accident and was transported to Greenville Memorial Hospital.

Lance Corporal Kathy Hiles of the SCHP said that despite the long period of time between the accident and the arrest, the case has been a priority for the agency, which also sent out its multi-disciplinary accident investigation team (MAIT) unit to reconstruct the collision.

“We had been working on it pretty diligently the whole time,” Hiles said. “It really came down to medical records and getting independent opinions on them.”

Hiles said Cibulskis had a documented history of seizures, and the investigation delved into the issue of whether or not he had been blatantly disregarding doctors’ orders.

“There were issues as to whether or not he should have been driving in the first place,” Hiles said.

Cibulskis is still being held at Oconee County Detention Center on $15,000 surety bond. His first court appearance is scheduled for July 31.

I'm so glad that he's finally being brought to justice. I think his parents should be brought forward to accept charges too for letting him drive knowing fully that he had no business behind the wheel of a car!!!

I am glad that the persistence of David's brothers and sisters finally paid off. Maybe now there will be justice for David.
