If the mayor and these individuals would like to see the Astro used as their plans would have it, I suggest they form a company, put up the cash or obtain investors or loans and either Buy or lease the building from the owners. To keep suggesting and asking (especially in the role of Mayor) that the owners of this property donate it to the City, is insulting and in my opinion, fiducially irresponsible as that would take a valuable, tax paying property from the city books. If I am correct, it is not a developer coming in and wanting to tear down the building or the owners selling it and not renewing a lease to the former movie theater, but the company that ran the theater made a business decision and that was probably due to being not profitable. I would be all for the plan this group is suggesting. They need to do it on their own dime however and not at the expense of the tax payers of Clemson.
Mr. Reinart is wrong in his assessment of the situation and the reasons why Mayor Abernathy wants a "refund". I believe the Mayor, like a lot of Clemson, Six Mile and Central folks are getting fed up with the way the School District treats the Daniel Area-particularly Clemson. In the past, almost every old school building or property had been sold or donated to the corresponding municipality for $1.00 or so, but in the case of the Annex, Clemson's high property values and the current zoning for that particular parcel of property had the school board at the time seeing green-they went back on the word and actions of school boards past and told Clemson it would have to bid for the property. Clemson and the Council did what it thought was in the best interest of the City at the time and did negotiate a very fair deal. The School Board and the members that do not represent the Daniel area have long treated this area with disdain and contempt-the recent 5-4 vote for the purchase of 23 acres so Daniel could put its Olympic sports facilities indicates that-Daniel and its feeder schools have long been the golden child of Pickens County-test scores and Athletics are far superior than that of the others- The Clemson area alone, if I am not mistaken contributes far more in tax dollars to the district than any other area. Mr Reinart is right in the fact that the deal has been struck and Clemson should not get a "refund", but I do believe the board needs to act consistently and fairly and stop looking Clemson (its gift horse)in the mouth.
What's interesting is the true ignorance of most people concerning our Constitution. This goes for most regular folks but especially for our politicians and judges. The Constitution was created by a Confederation of States and the Amendments limit the powers of the FEDERAL GOVERNMENT alone hence the reaon it states, "congress shall make no law..." That is to say, that the Federal Government cannot establish one religion over the other. The States, however, are left to their own accord. This is the reason for the 10th Amendment. "Those powers not delegated to the United States by the Constitution, nor prohibited by it to the States, are reserved to the States respectively, or to the people". South Carolina, as a soverign state has chosen to make prayer an acceptable practice in council meetings, etc. To insist,like Mayor Abernathy has done, that Federal Law may supercede State law is the crux of the problem we have with our spineless politicians that have created the massive, powerful federal government we have today. Our constitution is for limiting the powers of the federal government and ensuring the rights of the States and/or people. Our forefathers knew far too well what would happen if a government became too powerful. I would suggest that most all of them are spinning in in their graves now with where we have come. Stand up and be counted.
